Esprit Golf Terms and Conditions for Overseas Package Tours

  • Please be sure to read these Terms and Conditions before applying.

These Terms and Conditions, together with the brochure, constitute the written explanation of transaction conditions as stipulated in Article 12-4 of the Travel Agency Act and form part of the written contract as stipulated in Article 12-5 of the same Act.

1. Package Tour Contract

This tour is planned, marketed, and operated by Esprit Golf Co., Ltd. (hereinafter referred to as “the Company”). Customers participating in this tour will enter into a package tour contract (hereinafter referred to as the “Travel Contract”) with the Company.

The content and conditions of the Travel Contract are governed by the promotional advertisements, brochures, these Travel Conditions, the confirmation document (final itinerary) provided prior to departure, and the section on Package Tour Contracts in the Company’s General Terms and Conditions for Travel Agencies. However, for tours departing from or arriving in overseas destinations, the section on Package Tour Contracts in the Company’s Specific General Terms and Conditions for Overseas Travel Agencies (hereinafter referred to as the “Company’s Specific Terms and Conditions”) shall apply. Furthermore, for trips that include a cruise of three or more nights during the itinerary (excluding trips that use a vessel for departure from or arrival in Japan) and for which such details are stated in the brochure, the provisions of the section on Package Tours in our Travel Agency Terms and Conditions for Use of Cruise Ships (hereinafter referred to as “our Cruise Travel Terms and Conditions”) shall apply. Except for the provisions regarding cancellation fees in Article 15 (Customer’s Right of Cancellation), the Specific Terms and Conditions and the Cruise Travel Terms and Conditions shall have the same content as the section on Package Tour Contracts in our Travel Agency Terms and Conditions.

We undertake to make arrangements and manage the itinerary so that the customer can receive transportation, lodging, and other travel-related services (hereinafter referred to as “Travel Services”) provided by transportation and lodging providers, etc., in accordance with the travel itinerary specified by us.

2. Travel Application

You must apply by filling out the Company’s prescribed travel application form (hereinafter referred to as the “Travel Application Form”) with the required information at the Company’s “Authorized Business Office” as defined in the Travel Agency Act (hereinafter, sections 1 and 2 collectively referred to as “the Company”), and submit it along with the application fee listed below. The application fee will be treated as a partial or full payment toward the “Travel Price,” “Cancellation Fees,” and “Penalty Fees.” Furthermore, if you withdraw your application before the travel contract is concluded as stipulated in Section 4, we will refund the full amount of the application fee received.

  1. However, for specific periods and specific itineraries, the terms set forth in separate brochures shall apply. Additionally, different terms apply when using a loan.
  • The term “travel cost” in the table above refers to the “standard travel cost” defined in Paragraph 9.
  1. We accept applications for travel contract reservations via telephone, mail, fax, the Internet, or other means of communication. In such cases, the contract is not concluded at the time of reservation. You must submit the application form and pay the application fee to us within three days from the day following the date on which we notify you of our acceptance of the reservation. If the application fee is not paid within this period, we will treat the application as having never been made.
  2. When entering your name in Roman characters on the “Travel Application Form,” please enter it exactly as it appears on the passport you will use for the trip. If your name is entered incorrectly, it may be necessary to reissue airline tickets or correct your name with the relevant agencies. In such cases, we will charge the “Customer Substitution Fee” specified in Section 27, as if a customer substitution had occurred. Please note that depending on the circumstances of the transportation or accommodation providers, name corrections may not be permitted, and you may be required to cancel the travel contract. In such cases, we will charge the cancellation fee specified by us in Section 16.

3. Handling of Waiting Lists

If, at the time of application, a travel contract cannot be concluded immediately due to full capacity, full occupancy, or other reasons, we may—with your consent and after confirming the deadline by which you are willing to remain on the “cancellation waiting list”—register you as a “waiting list customer” and make every effort to accept your application. This is referred to as “waiting list registration.” Even in this case, we will collect an amount equivalent to the application fee. At this point, the travel contract has not yet been concluded. Furthermore, if “the customer requests cancellation of the waiting list registration before we notify them that we can accept their application,” or if “we are ultimately unable to accept the application by the agreed-upon waiting period,” we will refund the amount equivalent to the application fee.

In the case described in Section (1) above, the reservation for the tour associated with the waiting list registration shall be deemed confirmed when we notify you that we can accept your application and such notification reaches you.

The “amount equivalent to the application fee” we have received will be treated as the “application fee” once the reservation is confirmed.

4. Application Conditions

Persons under the age of 18 must provide a written consent form from a legal guardian. Additionally, persons under the age of 15 at the start of the trip may be required to be accompanied by a legal guardian.

For trips with special participation requirements, we may decline your application if the participant’s gender, age, qualifications, skills, or other conditions do not meet the criteria specified by us.

If you have health issues, use assistive devices such as a wheelchair, have a physical or mental disability, have food or animal allergies, are pregnant or may be pregnant, are accompanied by a service animal (guide dog, hearing dog, or assistance dog), or require other special accommodations, please inform us at the time of application that you require special consideration for participation. (Please also notify us immediately if any of these conditions arise after the travel contract has been concluded.) We will provide you with further details, so please specify the specific measures you will need during the trip.

Upon receiving a notification as described in the preceding paragraph, we will accommodate your request to the extent that it is possible and reasonable. In doing so, we may ask you about your circumstances and the necessary measures, or request that you provide this information in writing.

To ensure the safe and smooth execution of the trip, we may require conditions such as the accompaniment of an assistant or companion, the submission of a doctor’s medical certificate, or modifications to parts of the itinerary. Furthermore, if we are unable to arrange the measures you have requested, we may decline your application for the travel contract or cancel the travel contract. Please note that, in principle, you are responsible for the costs incurred for any special measures we take on your behalf based on your request.

If we determine that, during the trip, you have fallen into a condition requiring a medical diagnosis or treatment due to illness, injury, or other reasons, we will take the necessary measures to ensure the smooth operation of the trip. All costs associated with this shall be borne by you.

As a general rule, you may not split from the group for your own convenience. However, depending on the itinerary, we may accept such requests under separate conditions.

If you leave the tour group for your own convenience, you must notify us of this fact, as well as whether you plan to rejoin the group and the scheduled date and time of your return.

If we determine that you are causing a nuisance to other guests or are likely to disrupt the smooth operation of group activities, we may refuse your participation.

We may refuse your participation if you are determined to be a member of, an associate of, or affiliated with an organized crime group, a company associated with such a group, a corporate extortionist, or any other antisocial force.

We may refuse participation if you make violent or unreasonable demands against us, engage in threatening behavior or use violence in connection with transactions, or commit acts equivalent to these.

We may refuse participation if you spread false rumors, use deceit or intimidation to damage our reputation, interfere with our business operations, or commit acts equivalent to these.

We may also refuse your application for other business-related reasons.

5. Effective Date of the Travel Contract and Delivery of the Contract Document

The travel contract shall be deemed to have been concluded when we accept the contract and receive the application fee specified in Paragraph 2.

Promptly after the contract is formed as stipulated in paragraph (1) of this section, we will provide you with a written document (hereinafter referred to as the “Contract Document”) detailing the travel itinerary, the contents of the travel services, other travel conditions, and matters concerning our liability. The Contract Document consists of the brochure and these Travel Conditions.

The scope of travel services that we are obligated to arrange and manage under the travel contract shall be as set forth in the final itinerary.

For tours in this brochure for which the travel price has not yet been determined, the contract will be formally concluded once the travel price is finalized.

The Company shall apply the following provisions to the conclusion of a packaged tour contract in which multiple travelers traveling the same itinerary at the same time have designated a responsible representative (hereinafter referred to as the “Contract Representative”) when submitting their application.

Unless otherwise agreed upon in a special provision, we shall deem the Contract Representative to have full authority to act on behalf of the travelers comprising the group (hereinafter referred to as “Group Members”) in concluding the Package Tour Contract, and all transactions regarding travel services for said group shall be conducted with the Contract Representative.

We assume no liability whatsoever for any debts or obligations that the Contract Representative currently owes or is expected to owe in the future to the Members.

If the Contract Representative does not accompany the group, we will, after the start of the trip, regard a Member designated in advance by the Contract Representative as the Contract Representative.

6. Travel Terms and Conditions for Customers Entering into a Travel Contract via a Telecommunications Contract

We may accept travel applications via “telephone, mail, fax, the Internet, or other means of communication” from card members (hereinafter referred to as “Members”) of credit card companies with which we have partnerships (hereinafter referred to as “Partner Companies”), on the condition that “payment for the travel fare is received without the Member’s signature on the prescribed form.”

Correspondence contracts shall also comply with the “Section on Package Tour Contracts” of our “Travel Agency Terms and Conditions.”

The term “card usage date” as used in this section refers to the date on which the Member and we are required to fulfill our obligations regarding payment or refund of travel costs, etc., under the travel contract.

When applying for a contract by correspondence, the Member must provide us with the “name of the package tour,” “departure date,” “member number,” “card expiration date,” and other relevant information regarding the application.

A travel contract concluded via a telecommunications contract is formed when we issue a notice of acceptance of the application and such notice reaches the customer. In the case of an application made by telephone, the contract is deemed to be formed when we accept the application. Furthermore, in the case of an application made by mail, fax, or other means of communication, the contract is deemed to be formed when we issue a notice of acceptance of the contract and such notice reaches the customer.

When entering into a contract via telecommunications, if the member’s credit card is invalid or for other reasons we are unable to settle all or part of the debt related to the travel costs in accordance with the affiliated company’s card member terms and conditions, we may refuse to conclude the travel contract.

We will accept payment of the travel costs in the amount specified in the contract document via the affiliated company’s card without the member’s signature on the prescribed form. In this case, the card transaction date shall be deemed the date the travel contract is concluded.

When accepting travel applications using IT-related information and communication technologies such as mobile devices (e.g., i-mode) and the Internet, if we provide the information required to be included in the written itinerary, contract document, or confirmation document—which details the travel itinerary, the content of travel services, other travel conditions, and matters concerning our liability—via information and communication technology instead of delivering such documents, we will confirm that the required information has been recorded in a file on the member’s communication device.

If the member’s communication device does not have a file capable of recording the aforementioned details, we will record the details in a file on a communication device used by our company and confirm that the member has viewed the details.

7. Confirmation Document (Final Travel Itinerary)

As a document supplementing the contract document specified in Paragraph 5(2), we will provide you with a Confirmation Document (Final Travel Itinerary) containing the confirmed travel itinerary, flight numbers, and hotel names no later than the day before the trip begins. (As a general rule, we will endeavor to provide this between 10 and 7 days before the trip begins; however, for certain tours departing during specific periods such as the year-end and New Year holidays or Golden Week, we may provide it shortly before the trip begins. Even in such cases, we will provide it no later than the day before the trip begins.) However, if a booking is made on or after the 7th day prior to the trip start date (counting backward from the day before the trip begins), we will provide it by the day of departure. Delivery methods include mailing. Furthermore, even before the scheduled delivery date, if you contact us, we will explain the status of your arrangements.

8. Payment Due Date for Travel Costs

Travel costs must be paid between the 22nd day following the 60th day prior to the travel start date (hereinafter referred to as the “Reference Date”) and the travel start date.

If you apply on or after the Reference Date, payment must be made at the time of application or by a specified date prior to the travel start date.

9. Base Travel Price

The “Base Travel Price” refers to the amount obtained by adding the “amount listed as the travel price” in the promotional advertisement or brochure to the “amount listed as additional charges,” and then subtracting the “amount listed as a discount.” This base travel price serves as the basis for calculating the “application fee” in Paragraph 2, the “cancellation fee” in Paragraph 16(1), the “penalty fee” in Paragraph 17(2), and the “change compensation” in Paragraph 25.

10. Additional Charges and Discounts

The “additional charges” referred to in Paragraph 9 mean the following charges (except when they are included in the “travel price” and displayed in advance):

Additional charges for using a single room

Additional charges for upgrading to a hotel or room type that we refer to as “upgrade plans, etc.” in brochures and other materials

The difference in price when a “meals-included plan,” etc., is selected based on a “meals-not-included plan,” etc.

Additional charges for extending hotel stays, as referred to by the Company in brochures and other materials as “Extended Stay Plans”

The fare difference required for changing airline seat classes, as referred to by the Company in brochures and other materials as “C/F Class Additional Charges”

Other charges referred to in brochures and other materials as “○○○○ Additional Charges” (such as additional charges for early check-in or additional charges when the Company states in brochures and other materials that it will accommodate requests for specific airlines).

The “discounted fare” referred to in Section 9 means the following charges (except in cases where the discounted travel fare has been set in advance).

The per-person discounted fare referred to by the Company in brochures, etc., as “Triple Discount” or similar, which is set on the condition that three or more people stay in a single room

Other charges referred to in brochures, etc., as “△△△ Discounted Fare”

11. Child Fares and Infant Fares

Child rates apply to children who are 2 years of age or older but under 12 years of age as of the travel start date. Infant rates apply to those under 2 years of age as of the travel start date who do not occupy an airline seat. However, depending on the airline, the travel end date may be used as the basis. In such cases, this will be indicated in each brochure.

12. What Is Included in the Tour Price

Fares and charges for transportation such as air, sea, and rail services specified in the itinerary. Please note that fare classes vary depending on the tour package. Unless otherwise specified, these are Economy Class fares.

Fares for shuttle buses and other transportation included in the itinerary (between airports, stations, piers, and accommodations; excluding cases where the itinerary states “at the customer’s expense”).

Sightseeing fees specified in the itinerary (including bus fares, guide fees, admission fees, etc.).

Accommodation fees, taxes, and service charges specified in the itinerary (excluding cases where the itinerary states “at the customer’s expense.” Accommodation is based on two people sharing a double room).

Meal costs specified in the itinerary (excluding in-flight meals) and associated taxes and service charges.

Checked baggage fee for one piece of luggage (such as a suitcase) per person (For air travel, the limit is generally 20 kg per person, but this varies by class and destination. Additionally, some airlines may charge separate checked baggage fees. Please ask a staff member for details.) Baggage is transported by the relevant carrier, and our company acts on your behalf to arrange the transportation with the carrier.

Local baggage handling fees (not included in some tour packages). However, at certain airports, train stations, ports, or hotels, you may be required to carry your own luggage due to the absence of porters or other reasons.

Tour guide fees for tours with a tour guide

Additional fares and charges imposed by transportation providers (e.g., fuel surcharges) (except where it is separately indicated that these are not included in the tour price).

Regarding items (1) through (9) above, no refunds will be issued even if you do not use some of these services due to your own circumstances.

13. Items Not Included in the Tour Price

In addition to those listed in Section 12, the following items are not included in the tour price. The following are examples of such items.

Excess baggage fees (for items exceeding the specified weight, volume, or number)

Dry cleaning, telephone charges, tips for hotel bellhops, maids, etc., other additional meals and beverages, and other personal expenses, as well as any associated taxes and service charges

Expenses related to travel procedures (passport stamp fees, visa fees, vaccination fees, and travel agency handling fees for visa application services, etc.)

Transportation and accommodation expenses within Japan from your home to the departure or arrival airport

International Tourism Tax and airport facility usage fees when using airports within Japan

Airport taxes, departure taxes, and similar taxes outside Japan

Fees for optional tours (short trips at an additional cost) available only to those who wish to participate

Expenses incurred when a customer requests personal guidance, shopping assistance, etc., from a tour escort or similar staff; expenses arising from the customer’s injury, illness, etc.; expenses associated with retrieving lost or forgotten luggage due to the customer’s negligence; and expenses incurred in arranging for the customer to travel separately

14. Changes to the Terms of the Travel Contract

Even after the travel contract has been concluded, the Company may make changes to the terms of the travel contract in the event of natural disasters, war, riots, suspension of travel services by transportation or lodging providers, orders from government authorities, the provision of transportation services not in accordance with the original itinerary, or other circumstances beyond our control, we may, when deemed unavoidable to ensure the safe and smooth execution of the trip, promptly explain to the customer in advance the reasons why such circumstances are beyond our control and the causal relationship between them and the situation, and may change the travel itinerary, the content of travel services, or other terms of the travel contract (hereinafter referred to as the “Contract Terms”) .

However, in cases of emergency where it is unavoidable, we will provide an explanation after the change has been made.

15. Changes to the Travel Price

Even after the travel contract has been concluded, we may change the travel price in the following cases:

If the fares or charges of the transportation providers used increase or decrease significantly beyond what is normally anticipated due to significant changes in economic conditions or other factors, we will increase or decrease the travel price within the scope of such increase or decrease. However, when increasing the travel price, we will notify the customer of such increase no later than the 15th day prior to the travel start date, counting backward from the day before the travel start date.

If there is a significant reduction in the applicable fares and charges specified in this Section (1), we will reduce the travel price by the amount of such reduction in accordance with the provisions of this Section (1).

If a change to the contract terms pursuant to Paragraph 14 results in a decrease or increase in the costs required to carry out the tour (including cancellation fees, penalty charges, and other expenses already paid or to be paid for travel services not received due to such a change), we may adjust the tour price within that scope at the time of the contract change. (This excludes cases where the increase in costs is due to a shortage of seats, rooms, or other facilities at transportation or lodging providers, even though such providers are providing the relevant travel services.)

If we have stated in our brochures or other materials that the travel price varies depending on the number of participants using transportation or lodging services, and if the number of participants changes after the travel contract is concluded for reasons not attributable to us, we may adjust the travel price in accordance with the terms stated in our brochures or other materials. For example, if one member of a group booking cancels the contract, resulting in another customer being assigned a single room, we will charge a cancellation fee to the customer who canceled the contract and an additional single-room surcharge to the customer using the single room.

16. Customer’s Right to Cancel

You may cancel the travel contract at any time by paying the cancellation fees specified in the table below. Note that the “travel contract cancellation date” is based on the time you notify the agency where you made your reservation of your intention to cancel during its business hours on a business day.

Cancellation Fees

Tours involving air travel upon departure from or return to Japan

(Excluding tours using chartered aircraft.)

*Note 1: “Peak season” refers to the periods from December 20 to January 7, April 27 to May 6, and July 20 to August 31.

*Note 2: “Travel Cost” in the table above refers to the “Standard Travel Cost” defined in Section 9.

*Note 3: Changes to the “itinerary” or “departure date” made after the travel contract has been concluded are also subject to the cancellation fees listed above.

*Note 4: The above cancellation fees will also apply in the event of cancellation due to reasons beyond our control, such as loans or travel visa procedures.

“Tours Using Chartered Aircraft”: Cancellation fees are based on our terms and conditions as clearly stated in brochures and other materials.

“Trips Utilizing a Vessel for Departure from or Arrival in Japan”: Cancellation fees shall be based on our terms and conditions as specified in brochures and other materials.

“Trips that include a cruise of three nights or more in the itinerary and for which the brochure states that the Cruise Travel Terms and Conditions apply”: Cancellation fees shall be based on our terms and conditions as specified in brochures and other materials.

“Package tour contracts that utilize airline tickets with the same terms and conditions as those widely sold to consumers by airlines via their websites or other means at the time of departure from or return to Japan, and for which the written contract explicitly states that such tickets will be used, along with the name of the airline, the ticket cancellation conditions, and the amount of the cancellation fee” (tours using PEX fares, etc.):

Cancellation fees shall be based on our Terms and Conditions as specified in brochures and other materials.

Notwithstanding paragraph (1) above, for certain packages, such as those departing from or arriving at a destination overseas, cancellation fees shall be governed by the provisions of our Terms and Conditions pertaining to specific overseas travel.

Customers may cancel the travel contract without paying a cancellation fee prior to the start of the trip in the following cases:

When the terms of the contract are changed pursuant to Paragraph 14, provided, however, that such change is listed in the left column of the table in Paragraph 25 or is otherwise significant.

When the travel price is increased pursuant to the provisions of Paragraph 15(1).

When natural disasters, acts of war, riots, the suspension of travel services by transportation or lodging providers, orders from government authorities, or other circumstances arise, rendering the safe and smooth execution of the trip impossible or highly likely to become impossible.

When we fail to provide the customer with the final itinerary by the deadline specified in Paragraph 7.

When, due to reasons attributable to us, it becomes impossible to carry out the trip in accordance with the itinerary set forth in the written contract.

If the travel contract is canceled pursuant to paragraphs (1) or (2) of this section, we will refund the balance remaining after deducting the prescribed cancellation fee from the travel fare (or deposit) already paid (if the cancellation fee exceeds the deposit, we will collect the difference). Furthermore, if the travel contract is canceled pursuant to paragraph (3) of this section, we will refund the full amount of the travel fare (or deposit) already paid.

If, after the trip has begun, you cancel the travel contract or temporarily withdraw from the trip for personal reasons, this will be deemed a waiver of your rights, and no refund will be provided.

If, for reasons not attributable to you, you are unable to receive the travel services specified in the final itinerary, you may cancel the portion of the contract pertaining to the travel services that have become impossible to provide without paying the cancellation fees specified in paragraphs (1) and (2) of this section. In such cases, we will refund the amount remaining after deducting any cancellation fees, penalty charges, or other applicable charges incurred for the relevant travel services.

17. Our Right to Cancel: Cancellation Before the Start of the Trip

We may terminate the travel contract prior to the start of the trip by explaining the reasons to you in the following cases:

When it becomes clear that you do not meet the conditions for participants—such as gender, age, qualifications, skills, or other requirements—that we have specified in advance.

When it is determined that you are unable to endure the trip due to illness, the absence of a necessary caregiver, or other reasons.

When it is determined that you are causing a nuisance to other customers or are likely to hinder the smooth operation of the group tour.

When a customer demands a burden regarding the terms of the contract that exceeds reasonable limits.

When the number of customers does not reach the minimum number of participants specified for each tour. In this case, we will notify the customer of the cancellation no later than the 23rd day prior to the travel start date (or the 33rd day for trips commencing during peak periods as defined in Note 1 of Paragraph 16(1)).

When the travel conditions explicitly stated by us in advance are not met—such as insufficient snowfall for a ski trip—or when there is a very high likelihood that they will not be met.

When, due to natural disasters, war, riots, the suspension of travel services by transportation or lodging providers, orders from government authorities, or other causes beyond our control, the safe and smooth execution of the trip in accordance with the itinerary set forth in the written contract becomes impossible, or there is a very high likelihood that it will become impossible.

As an example of the situation described in Section 7 above, when the Ministry of Foreign Affairs issues a travel advisory for a region included in the itinerary stating “Please refrain from non-essential and non-urgent travel” or a higher level of warning. However, the trip will proceed if it is possible to implement sufficient safety measures. In such cases (when we proceed with the trip), if the customer cancels the trip, the cancellation fees specified in Section 16(1) and (2) will apply.

When it is determined that the customer falls under any of the provisions of Section 4(7) through (9).

If the customer fails to pay the travel fare by the deadline specified in Section 8, we shall deem the customer to have terminated the travel contract on the day following said deadline. In this case, the customer shall pay us a penalty equivalent to the cancellation fee specified in Section 16(1). Furthermore, if the travel contract is canceled pursuant to paragraph (1) of this section, we will refund the full amount of the travel fare (or application fee) already received.

18. Our Right to Cancel: Cancellation After the Start of the Trip

We may cancel part of the travel contract even after the trip has begun in the following cases:

When the customer is unable to continue the trip due to illness, the absence of a necessary caregiver, or other reasons.

When the customer disrupts the discipline of group activities and hinders the safe and smooth conduct of the trip by violating the Company’s instructions given by the tour escort or other personnel necessary for the safe and smooth conduct of the trip, or by committing acts of violence or intimidation against such personnel or other traveling companions.

When it becomes impossible to continue the trip due to natural disasters, war, riots, the suspension of travel services by transportation or lodging providers, orders from government agencies, or other reasons beyond our control.

As an example of the situation described in Section 3 above, when the Ministry of Foreign Affairs issues a travel advisory for a region included in the itinerary stating “Avoid non-essential and non-urgent travel” or higher, making it impossible to continue the trip.

When it is determined that the customer falls under any of the provisions of Paragraph 4 (7) through (9).

If we terminate the travel contract pursuant to the provisions of this Paragraph (1), the contractual relationship between us and the customer shall be terminated only prospectively. In other words, our obligations regarding travel services already provided to the customer shall be deemed to have been validly fulfilled. Furthermore, if there are any expenses—such as cancellation fees, penalty charges, or other charges—that have already been paid or must be paid to the provider of travel services that could not be received due to the termination of the contract, the customer shall bear these costs. In such cases, the Company shall refund the portion of the travel price corresponding to the travel services the customer has not yet received, after deducting any cancellation fees, penalty charges, or other expenses that the Company has paid or is required to pay to the relevant travel service provider.

19. Refund of the Travel Price

If the travel price is reduced pursuant to the provisions of Paragraph 15, or if the travel contract is terminated pursuant to the provisions of Paragraphs 16, 17, 18, and an amount is due to the customer, we will refund such amount to the customer within 7 days from the day following the date of cancellation for refunds resulting from cancellation prior to the travel start date, and within 30 days from the day following the travel end date specified in the written contract for refunds resulting from a reduction in the travel price or cancellation after the travel start date. However, if the travel contract is canceled pursuant to Paragraph 18(1), the customer shall bear any cancellation fees, penalties, or other expenses already paid or to be paid in the future for travel services that were not provided due to the cancellation of the trip.

20. Return Travel Arrangements Following Contract Cancellation

If we cancel the travel contract after the start of the trip pursuant to the provisions of Paragraph 18(1)(1) or (3), we will, at the customer’s request and at the customer’s expense, arrange the travel services necessary for the customer to return to the point of departure.

21. Our Instructions

When traveling as part of a group from the start of the trip until its conclusion, the customer must follow our instructions to ensure the safe and smooth conduct of the trip.

22. Tour Escort

The presence or absence of a tour escort will be clearly stated in the brochure.

For trips accompanied by a tour escort, the tour escort will perform all or part of the duties necessary to ensure the safe and smooth conduct of the trip, as well as any other duties deemed necessary by us; for trips not accompanied by a tour escort, local staff at the destination will perform such duties.

For trips not accompanied by a tour escort, our local contact information will be clearly stated in the final itinerary.

As a general rule, the tour escort’s working hours are from 8:00 a.m. to 8:00 p.m.

Cancellation Fees

Itineraries involving air travel upon departure from or return to Japan

(Excluding itineraries using chartered aircraft.)

*Note 1: “Peak Season” refers to the periods from December 20 to January 7, April 27 to May 6, and July 20 to August 31.

*Note 2: “Travel Cost” in the table above refers to the “Standard Travel Cost” defined in Section 9.

*Note 3: Changes to the “itinerary” or “departure date” made after the travel contract has been concluded are also subject to the cancellation fees listed above.

*Note 4: The above cancellation fees will also apply in the event of cancellation due to reasons beyond our control, such as loans or travel visa procedures.

“Tours Using Chartered Aircraft”: Cancellation fees are based on our terms and conditions as clearly stated in brochures and other materials.

“Trips Utilizing a Vessel for Departure from or Arrival in Japan”: Cancellation fees shall be based on our terms and conditions as clearly stated in brochures and other materials.

“Trips that include a cruise of three nights or more in the itinerary and for which the brochure states that the Cruise Travel Terms and Conditions apply”: Cancellation fees shall be based on our terms and conditions as clearly stated in brochures and other materials.

“Package tour contracts that utilize airline tickets with the same terms and conditions as those widely sold to consumers by airlines via their websites or other means at the time of departure from or return to Japan, and for which the contract document explicitly states that such tickets will be used, along with the name of the airline, the ticket cancellation conditions, and the amount of the cancellation fee” (tours using PEX fares, etc.):

Cancellation fees shall be based on our terms and conditions as specified in brochures and other materials.

Notwithstanding paragraph (1) above, for specific packages, such as those departing from or arriving at a destination overseas, cancellation fees shall be determined in accordance with the provisions of our Terms and Conditions regarding specific overseas travel.

Customers may cancel the travel contract without paying a cancellation fee prior to the start of the trip in the following cases:

When the terms of the contract are changed pursuant to Paragraph 14, provided, however, that such change is listed in the left column of the table in Paragraph 25 or is otherwise significant.

When the travel price is increased pursuant to the provisions of Paragraph 15(1).

When natural disasters, acts of war, riots, the suspension of travel services by transportation or lodging providers, orders from government authorities, or other circumstances arise, rendering the safe and smooth execution of the trip impossible or highly likely to become impossible.

When we fail to provide the customer with the final itinerary by the deadline specified in Paragraph 7.

When, due to reasons attributable to us, it becomes impossible to carry out the trip in accordance with the itinerary set forth in the written contract.

If the travel contract is canceled pursuant to paragraphs (1) or (2) of this section, we will refund the balance remaining after deducting the prescribed cancellation fee from the travel fare (or deposit) already paid (if the cancellation fee exceeds the deposit, we will collect the difference). Furthermore, if the travel contract is canceled pursuant to paragraph (3) of this section, we will refund the full amount of the travel fare (or deposit) already paid.

If, after the trip has begun, you cancel the travel contract or temporarily withdraw from the trip for personal reasons, this will be deemed a waiver of your rights, and no refund will be provided.

If, for reasons not attributable to the customer, the customer is unable to receive travel services in accordance with the final itinerary, the customer may cancel the portion of the contract pertaining to the travel services that have become impossible to provide without paying the cancellation fees specified in paragraphs (1) and (2) of this section. In such cases, we will refund the amount remaining after deducting any cancellation fees, penalty charges, or other applicable charges incurred for the relevant travel services.

17. Our Right to Cancel: Cancellation Prior to the Start of the Trip

We may terminate the travel contract prior to the start of the trip by explaining the reasons to you in the following cases:

When it becomes clear that you do not meet the conditions for participants—such as gender, age, qualifications, skills, or other requirements—that we have specified in advance.

When it is determined that you are unable to endure the trip due to illness, the absence of a necessary caregiver, or other reasons.

When it is determined that you are causing a nuisance to other customers or are likely to hinder the smooth operation of the group tour.

When a customer demands a burden exceeding reasonable limits regarding the terms of the contract.

When the number of customers does not reach the minimum number of participants specified for each tour. In this case, we will notify the customer of the cancellation no later than the 23rd day prior to the travel start date (or the 33rd day for trips commencing during peak periods as defined in Note 1 of Paragraph 16(1)).

When the travel conditions explicitly stated by us in advance are not met—such as insufficient snowfall for a ski trip—or when there is a very high likelihood that they will not be met.

When, due to natural disasters, war, riots, the suspension of travel services by transportation or lodging providers, orders from government authorities, or other causes beyond our control, the safe and smooth execution of the trip in accordance with the itinerary set forth in the written contract becomes impossible, or there is a very high likelihood that it will become impossible.

As an example of the situation described in Section 7 above, when the Ministry of Foreign Affairs issues a travel advisory for a region included in the itinerary stating “Please refrain from non-essential and non-urgent travel” or a higher level of warning. However, the trip will proceed if it is possible to implement sufficient safety measures. In such cases (when we proceed with the trip), if the customer cancels the trip, the cancellation fees specified in Section 16(1) and (2) will apply.

When it is determined that the customer falls under any of the provisions of Section 4(7) through (9).

If the customer fails to pay the travel fare by the deadline specified in Section 8, we shall deem the customer to have terminated the travel contract on the day following said deadline. In this case, the customer shall pay us a penalty equivalent to the cancellation fee specified in Section 16(1). Furthermore, if the travel contract is canceled pursuant to paragraph (1) of this section, we will refund the full amount of the travel fare (or application fee) already received.

18. Our Right to Cancel: Cancellation After the Start of the Trip

We may cancel part of the travel contract even after the trip has begun in the following cases:

When the customer is unable to continue the trip due to illness, the absence of a necessary caregiver, or other reasons.

When the customer disrupts the discipline of group activities and hinders the safe and smooth conduct of the trip by violating the Company’s instructions given by the tour escort or other personnel necessary for the safe and smooth conduct of the trip, or by committing acts of violence or intimidation against such personnel or other traveling companions.

When it becomes impossible to continue the trip due to natural disasters, war, riots, the suspension of travel services by transportation or lodging providers, orders from government agencies, or other reasons beyond our control.

As an example of the situation described in Section 3 above, when the Ministry of Foreign Affairs issues a travel advisory for a region included in the itinerary stating “Avoid non-essential and non-urgent travel” or higher, making it impossible to continue the trip.

When it is determined that the customer falls under any of the provisions of Paragraph 4 (7) through (9).

If we terminate the travel contract pursuant to the provisions of this Paragraph (1), the contractual relationship between us and the customer shall be terminated only prospectively. In other words, our obligations regarding travel services already provided to the customer shall be deemed to have been validly fulfilled. Furthermore, if there are any expenses—such as cancellation fees, penalty charges, or other charges—that have already been paid or must be paid to the provider of travel services that the customer was unable to receive due to the termination of the contract, the customer shall bear these costs. In such cases, the Company shall refund the portion of the travel price corresponding to the travel services the customer has not yet received, after deducting any cancellation fees, penalty charges, or other expenses that the Company has paid or is required to pay to the relevant travel service provider.

19. Refund of Travel Costs

If the travel costs are reduced pursuant to the provisions of Paragraph 15, or if the travel contract is terminated pursuant to the provisions of Paragraphs 16, 17, 18, and an amount is due to the customer, we will refund such amount to the customer within 7 days from the day following the date of cancellation for refunds resulting from cancellation prior to the travel start date, and within 30 days from the day following the travel end date specified in the written contract for refunds resulting from a reduction in the travel price or cancellation after the travel start date. However, if the travel contract is canceled pursuant to Paragraph 18(1), the customer shall bear any cancellation fees, penalties, or other expenses already paid or to be paid in the future for travel services that were not provided due to the cancellation of the trip.

20. Return Travel Arrangements Following Contract Cancellation

If we cancel the travel contract after the start of the trip pursuant to the provisions of Paragraph 18(1)(1) or (3), we will, at the customer’s request and at the customer’s expense, arrange the travel services necessary for the customer to return to the point of departure.

21. Our Instructions

23. Our Liability and Exemptions

In the performance of the travel contract, we shall be liable to compensate the customer for any damages caused by our intentional acts or negligence, or those of our travel agent. However, this applies only if we are notified within two years from the day following the occurrence of the damage.

For example, even if the customer suffers damages due to the reasons listed below, we cannot assume liability under this section (1). However, this shall not apply if the intentional act or negligence of the Company or its travel agent is proven.

Natural disasters, wars, riots, or changes to the travel itinerary or cancellation of the trip resulting from these events

Accidents or fires involving transportation or lodging providers

Suspension of services by transportation or lodging providers, or changes to the travel itinerary or cancellation of the trip resulting from these events

Orders from Japanese or foreign government authorities, foreign entry/exit restrictions, quarantine due to infectious diseases, or changes to the travel itinerary or cancellation of the trip resulting from these

Accidents occurring during free time

Food poisoning

Theft

Delays, service suspensions, schedule changes, route changes, etc., by transportation providers, or changes to the travel itinerary or shortened stay at the destination resulting from these

Other causes beyond the control of the Company or its travel agent

Notwithstanding the provisions of paragraph (1) of this section, the Company shall compensate for damage to baggage, as described in that paragraph, only if the Company is notified within 21 days from the day following the occurrence of the damage, up to a limit of 150,000 yen per customer (excluding cases of willful misconduct or gross negligence).

24. Special Compensation

Regardless of whether our liability arises under the provisions of Section 23, if a customer suffers certain damages to life, body, or luggage, we will pay compensation in accordance with the Special Compensation Regulations of the Travel Agency Terms and Conditions: 25 million yen as a death benefit; 40,000 to 400,000 yen as hospitalization allowance, depending on the number of days hospitalized; 20,000 to 100,000 yen as outpatient allowance, depending on the number of days of outpatient treatment; and compensation for damage to personal belongings (up to 150,000 yen; however, the compensation limit per item or pair is 100,000 yen). However, for days explicitly stated in the itinerary as days on which no travel services arranged by the Company will be provided, such days shall not be considered “during participation in this tour” only if it is explicitly stated that no compensation will be paid for damages sustained by the customer on those days.

If we become liable under Section 23(1), this compensation shall be applied toward all or part of the damages for which we are liable.

Among the short trips (optional tours) conducted for customers participating in our packaged tours for which a separate fee is charged, those planned and conducted by us shall be treated as part of the main packaged tour contract.

If damage sustained by a customer during participation in a packaged tour results from the customer’s willful misconduct, intentional violation of laws or regulations, illness, or other causes not included in the packaged tour—such as accidents occurring during free time while engaging in skydiving, mountain climbing, bobsledding, luge, hang gliding, or other similar dangerous activities—the Company shall not pay the compensation or condolence money specified in this Section (1). However, this shall not apply if the activity in question is included in the organized package tour itinerary.

25. Itinerary Guarantee

In the event of a material change to the contract details listed in the left column of the table below (excluding the changes listed in 1., 2., and 3. below), the Company shall pay the customer a change compensation amount calculated by multiplying the tour price by the rate specified in the right column of the same table within 30 days from the day following the end of the tour. However, this shall not apply if it is clear that the Company is liable for the change in question pursuant to the provisions of Section 23(1).

The Company shall not pay change compensation in the event of changes due to the following causes. (However, the Company shall pay change compensation in the event of changes caused by a shortage of seats, rooms, or other facilities at transportation or lodging providers, etc., despite the provision of services.)

(e) Suspension of travel services by transportation or lodging providers, such as flight cancellations, service interruptions, or closures

(f) Provision of transportation services that deviate from the original schedule, such as delays or changes to transportation schedules

(g) Measures necessary to ensure the safety of the lives or bodies of travel participants

Changes pertaining to the portion of the trip that was canceled when the travel contract was terminated in accordance with the provisions of Paragraphs 16 through 18

Even if the order in which the travel services listed in the brochure are provided is changed, we will not pay change compensation if the customer was able to receive those travel services during the trip.

The amount of change compensation we are required to pay shall be limited to 15% of the travel price per customer per packaged tour. Furthermore, if the amount of change compensation payable per customer for a single packaged tour is less than 1,000 yen, we will not pay change compensation. The travel price used as the basis for calculating change compensation shall be the “Standard Travel Price” as defined in Paragraph 9.

If, after we have paid change compensation pursuant to the provisions of this paragraph (1), it becomes clear that we are liable under Paragraph 23 (1), the customer must reimburse the Company for the change compensation related to said change. In such a case, the Company shall pay the balance remaining after offsetting the amount of damages the Company is required to pay pursuant to the provisions of the same paragraph against the amount of change compensation the customer is required to reimburse.

With the customer’s consent, the Company may provide goods or services of equal or greater value in lieu of paying change compensation in cash.

26. Customer’s Liability

If the Company suffers damages due to the Customer’s willful misconduct or negligence, acts that violate laws, regulations, or public order and morals, or the Customer’s failure to comply with the provisions of the Company’s Terms and Conditions, the Company shall seek compensation for such damages from the Customer.

The Customer must make every effort to understand the rights and obligations of travelers and other terms of the packaged tour contract as set forth in the written contract by utilizing the information provided by the Company.

If, after the trip begins, the Customer becomes aware that any travel service described in the written contract differs from what is stated, the Customer must promptly notify the Company, the Company’s agent, or the travel service provider of this fact at the travel destination.

27. Substitution of the Customer

The customer may transfer their status under the travel contract to another person with our consent. In such cases, the customer must complete the prescribed form with the required information and submit it to us along with a handling fee (11,000 yen per person). (If airline tickets have already been issued, we may charge separate fees for reissuing the tickets.)

The transfer of status under the travel contract shall take effect upon our approval, and thereafter, the person to whom the status has been transferred shall succeed to all rights and obligations of the customer under the travel contract. Please note that we may refuse the transfer if, for reasons such as the transport or accommodation providers not accepting the change of traveler, the transfer is not permitted.

28. Matters to Be Completed by the Customer Before Departure

Passports and Visas (Non-Japanese nationals should contact their home country’s consulate, the consulate of the destination country, or an immigration office.)

Passport: To participate in the tour, you must have a passport with a remaining validity period as specified in the brochure.

Visa: To participate in the tour, you must have a visa for the countries listed in the brochure. It is your sole responsibility to confirm whether your current passport is valid for this trip, as well as to obtain the necessary passports, visas, re-entry permits, and various certificates, and to prepare immigration documents. However, for a specified fee, we will handle part of the travel procedures on your behalf under a separate contract (Travel Procedure Agency Contract). In such cases, we assume no responsibility if you are unable to obtain a passport, visa, or other required documents due to reasons attributable to you.

Health and Hygiene: Please check the health and hygiene conditions of your destination (country or region) on the Ministry of Health, Labour and Welfare’s “Quarantine Infectious Diseases Information Website” (http://www.forth.go.jp/).

Overseas Safety Information: Depending on your destination (country or region), information regarding travel to that country or region—such as the Ministry of Foreign Affairs’ “Overseas Safety Information”—may be available. At the time of booking, the travel agency will provide you with a “Document Regarding Overseas Safety Information.” Please also check the Ministry of Foreign Affairs’ “Overseas Safety Website” (http://www.anzen.mofa.go.jp).

29. Handling of Personal Information

We will use the personal information you provide for the following purposes: 1. To communicate with you and to register you in the Overseas Safety Information System provided by Japanese government agencies (a system for providing safety information about your travel destination and for confirming your safety in emergencies); 2. To arrange and provide travel-related services, such as transportation and accommodations; 3. To handle various travel-related procedures; 4. to process insurance procedures that cover expenses in the event of an accident under our liability under the travel contract; 5. to provide information on products, services, and promotional campaigns offered by us and our partner companies, as well as travel-related information; 6. to request your opinions and feedback after your trip; 7. to request your participation in surveys; 8. to provide special benefits; and 9. to compile statistical data.

To achieve the purposes listed in 2. and 3. above, we may provide your name, address, phone number, passport number, flight number, and other information to transportation and lodging providers, souvenir shops, embassies, and immigration officials (both in Japan and abroad) via documents or electronic data. Additionally, for the purpose of settling your travel expenses, we may provide your credit card number and payment amount to payment processing companies and credit card companies via electronic means or other methods. If you wish to opt out of having your personal information provided to souvenir shops, please notify the travel application desk listed in the relevant brochure at least 10 days prior to your departure. (Note: If the 10th day prior to departure falls on a Saturday, Sunday, or national holiday, please notify us by the previous day.)

Our company and our group companies will jointly use the contact information—such as name, address, phone number, and email address—provided by you in writing for the purpose of sending sales information and campaign announcements from each company. We will take full responsibility for managing the personal information used jointly. For details regarding our policies on the handling of personal information and the names of our group companies, please refer to the Privacy Policy available at our stores or on our website.

We may outsource the handling of personal information.

You may request the disclosure, correction, deletion, or suspension of use of personal data held by us. Please refer to our website at “https://espritgolf.net/” or contact us by phone at “0422-38-4822.”

If you do not fill out certain optional fields, we may not be able to properly provide services related to those unfilled fields.

30. Handling of Domestic Airline Tickets to the Travel Departure Point Listed in the Brochure

Booking: We ask that you book domestic airline tickets using the special fares listed in the brochure at the same time you book the tour.

The contract regarding the arrangement of domestic airline tickets described in Section (1) of this article shall be concluded upon our acceptance. Once we have accepted the domestic flight segment, the arrangement shall constitute a packaged tour contract—including the overseas portion of the relevant tour—and shall be subject to special compensation, itinerary management, and itinerary guarantees.

Cancellation: If we are unable to reserve or secure the domestic airline tickets at the special fare listed in the brochure that you requested, and you cancel the relevant tour, you will be required to pay the prescribed cancellation fee for that tour.

31. Other Matters

Overseas Travel Insurance

In the event of illness or injury, substantial medical and transportation expenses may be incurred. Furthermore, in the event of an accident, it is extremely difficult to claim compensation from the party at fault or to receive compensation payments; therefore, we strongly recommend that you purchase overseas travel insurance with sufficient coverage on your own.

Shopping Information

For your convenience, we may take you to souvenir shops during sightseeing or transfers; however, any purchases you make are at your own risk. We are unable to assist with exchanges or returns of merchandise; to avoid any issues, please be sure to inspect the items and obtain a receipt. If you are eligible for a tax refund, please be sure to keep your purchases with you in your carry-on luggage. Please confirm the procedures at the souvenir shop or airport and complete the process on your own responsibility. Please exercise extreme caution when making purchases, as certain items are prohibited from being taken out of foreign countries or brought into Japan under the Washington Convention or other laws and regulations.

Frequent Flyer Programs

You are responsible for making inquiries and registering for airline frequent flyer programs directly with the respective airline. Furthermore, if you are unable to receive a service you were scheduled to receive due to a change in the airline used, regardless of the reason, we shall not be liable under Section 23(1) or Section 25(1). (Note) Section 23: Our Liability and Disclaimers; Section 25: Itinerary Guarantee

Reporting Accidents, etc.

If an accident or other incident occurs during your trip, please immediately notify the contact information provided in the final itinerary. (If you are unable to notify us for any reason, please do so as soon as the circumstances permitting.)

The scope of our obligation to manage the itinerary under the Package Tour Contract extends from the time of departure (meeting) from the departure airport specified in the description of each tour in the brochure (or, for tours with special domestic flight rates that we have approved and for which the Package Tour Contract has been concluded to include the domestic segment, the domestic flight departure airport) until the time of return (dispersion) to that airport.

Under no circumstances will we reschedule the tour.

32. Terms and Conditions of Package Tour Contracts

Matters not specified in these terms and conditions shall be governed by our Travel Agency Terms and Conditions (Section on Package Tour Contracts). 33. Effective Date of Travel Conditions

These travel conditions are effective as of April 1, 2023.
